1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge über Tandem-Paragliding-Flüge, die zwischen Fliagmo (nachfolgend „Anbieter“) und dem Kunden (nachfolgend „Passagier“) geschlossen werden. Mit der Buchung eines Tandemfluges erkennt der Passagier diese AGB verbindlich an.
2. Leistungen
Fliagmo bietet die Vermittlung und Organisation von Tandem-Gleitschirmflügen mit professionellen, staatlich zugelassenen Tandempiloten an. Die Durchführung des Fluges selbst obliegt ausschließlich dem jeweiligen Piloten.
3. Teilnahmevoraussetzungen
• Körpergewicht: zwischen 20 kg und 120 kg
• Mindestalter: 4 Jahre (unter 18 Jahren nur mit schriftlicher Zustimmung eines Erziehungsberechtigten)
• Keine gesundheitlichen Einschränkungen (z. B. Herz-Kreislauf-Erkrankungen, Epilepsie, Schwangerschaft etc.)
Der Passagier verpflichtet sich, wahrheitsgemäß Auskunft über seinen Gesundheitszustand zu geben.
4. Wetter- und Sicherheitsbedingungen
Tandemflüge sind wetterabhängig. Der jeweilige Pilot entscheidet allein über die Durchführung, Verschiebung oder Absage eines Fluges aus sicherheitsrelevanten Gründen. Bei wetterbedingter Absage wird ein Ersatztermin angeboten. Ein Anspruch auf Rückerstattung besteht nur, wenn kein Ersatztermin möglich ist.
5. Rücktritt / Stornierung durch den Passagier
• Kostenlose Stornierung bis 24 Stunden vor dem Termin
• Ab 24 Stunden vor dem Termin oder bei Nichterscheinen: voller Preis fällig
• Eine Ersatzperson kann benannt werden, sofern sie die Teilnahmevoraussetzungen erfüllt
6. Rücktritt durch den Anbieter
Der Anbieter kann einen Flug bei widrigen Wetterverhältnissen, höherer Gewalt oder organisatorischen Gründen absagen. Es wird ein Ersatztermin angeboten. Weitergehende Ansprüche gegenüber dem Anbieter sind ausgeschlossen.
7. Verantwortung und Haftung
Fliagmo ist ausschließlich Vermittler und organisatorischer Anbieter von Tandemflügen.
Der eigentliche Flug wird rechtlich, fachlich und haftungsrechtlich vollständig und eigenverantwortlich vom jeweiligen Piloten durchgeführt.
Der Anbieter (Fliagmo) haftet nicht für Schäden oder Unfälle, die während des Fluges entstehen. Die Verantwortung und Haftung für den Flug sowie die Sicherheit des Passagiers liegt allein beim durchführenden Piloten – unabhängig davon, wo oder durch wen der Flug gebucht oder bezahlt wurde.
Der Passagier erkennt an, dass:
• der Pilot selbstständig handelt,
• er den Flug auf eigene Gefahr antritt,
• alle Entscheidungen zum Flugverlauf, Start, Sicherheit und Landung beim Piloten liegen.
8. Versicherung
Alle eingesetzten Tandempiloten verfügen über die gesetzlich vorgeschriebene Luftfahrt-Haftpflichtversicherung. Zusätzliche Unfallversicherungen sind nicht enthalten und liegen in der Verantwortung des Passagiers.
9. Foto- und Videoaufnahmen
Sofern während des Fluges Foto- oder Videoaufnahmen gemacht werden, erklärt sich der Passagier mit deren Nutzung für private oder werbliche Zwecke durch Fliagmo einverstanden – sofern nicht ausdrücklich widersprochen wurde.
10. Gutscheine
Gutscheine sind 1 Jahr ab Ausstellungsdatum gültig. Nach Ablauf kann die Einlösung nur nach Absprache und gegen Aufpreis erfolgen. Eine Auszahlung in bar ist ausgeschlossen. Die Einlösung ist nur nach vorheriger Terminvereinbarung möglich.
11. Gerichtsstand und Recht
Es gilt ausschließlich das Recht der Italienischen Republik.
Gerichtsstand ist, soweit gesetzlich zulässig, der Sitz des Anbieters.
12. Salvatorische Klausel
Sollte eine Bestimmung dieser AGB ganz oder teilweise unwirksam sein, bleibt die Gültigkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen Regelung tritt eine Bestimmung, die dem wirtschaftlich Gewollten am nächsten kommt.
Condizioni Generali di Contratto (CGC) Fliagmo – Parapendio Biposto

1. Ambito di applicazione
Le presenti Condizioni Generali di Contratto (CGC) si applicano a tutti i contratti relativi ai voli in parapendio biposto conclusi tra Fliagmo (di seguito “fornitore”) e il cliente (di seguito “passeggero”). Con la prenotazione di un volo in tandem, il passeggero accetta in modo vincolante le presenti CGC.
2. Servizi
Fliagmo offre l’intermediazione e l’organizzazione di voli in parapendio biposto con piloti professionisti autorizzati. L’esecuzione del volo è responsabilità esclusiva del rispettivo pilota.
3. Requisiti di partecipazione
• Peso corporeo: tra 20 kg e 120 kg
• Età minima: 4 anni (sotto i 18 anni solo con consenso scritto di un genitore/tutore)
• Nessuna limitazione di salute (ad es. malattie cardiovascolari, epilessia, gravidanza ecc.)
Il passeggero si impegna a fornire informazioni veritiere sul proprio stato di salute.
4. Condizioni meteorologiche e di sicurezza
I voli in tandem dipendono dalle condizioni meteorologiche. Il rispettivo pilota decide da solo sull’esecuzione, lo spostamento o l’annullamento del volo per motivi di sicurezza. In caso di annullamento dovuto al meteo, verrà offerta una data alternativa. Un rimborso è possibile solo se non è disponibile alcuna data alternativa.
5. Recesso / Annullamento da parte del passeggero
• Cancellazione gratuita fino a 24 ore prima del volo
• Da 24 ore prima del volo o in caso di mancata presentazione: pagamento dell’intero prezzo
• È possibile nominare una persona sostitutiva, purché soddisfi i requisiti di partecipazione
6. Recesso da parte del fornitore
Il fornitore può annullare un volo in caso di condizioni meteorologiche avverse, forza maggiore o motivi organizzativi. Verrà offerta una data alternativa. Ulteriori reclami nei confronti del fornitore sono esclusi.
7. Responsabilità e obblighi
Fliagmo è esclusivamente un intermediario e organizzatore di voli biposto. L’esecuzione effettiva del volo è condotta legalmente e professionalmente in piena autonomia dal rispettivo pilota.
Il fornitore (Fliagmo) non è responsabile per danni o incidenti che si verificano durante il volo. La responsabilità e la sicurezza del passeggero sono a carico esclusivo del pilota – indipendentemente dal canale di prenotazione o pagamento.
Il passeggero riconosce che:
• il pilota agisce in modo indipendente,
• intraprende il volo a proprio rischio,
• tutte le decisioni sullo svolgimento del volo, decollo, sicurezza e atterraggio spettano al pilota.
8. Assicurazione
Tutti i piloti impiegati dispongono dell’assicurazione obbligatoria di responsabilità civile aeronautica. Ulteriori assicurazioni contro gli infortuni non sono incluse e sono a carico del passeggero.
9. Foto e registrazioni video
Se durante il volo vengono effettuate foto o registrazioni video, il passeggero acconsente al loro utilizzo a fini privati o pubblicitari da parte di Fliagmo – a meno che non si opponga espressamente.
10. Buoni
I buoni hanno una validità di 1 anno dalla data di emissione. Dopo la scadenza, possono essere riscattati solo previo accordo e con un sovrapprezzo. Non è previsto alcun rimborso in contanti. L’utilizzo è possibile solo previa prenotazione.
11. Foro competente e diritto applicabile
Si applica esclusivamente il diritto della Repubblica Italiana. Il foro competente è, per quanto consentito dalla legge, la sede del fornitore.
12. Clausola salvatoria
Se una disposizione delle presenti CGC è in tutto o in parte invalida, la validità delle restanti disposizioni rimane invariata. Al posto della disposizione invalida si applica una disposizione che si avvicina maggiormente all’intento economico originario.
General Terms and Conditions (GTC) Fliagmo – Tandem Paragliding

1. Scope
These General Terms and Conditions (GTC) apply to all contracts for tandem paragliding flights concluded between Fliagmo (hereinafter referred to as the “provider”) and the customer (hereinafter referred to as the “passenger”). By booking a tandem flight, the passenger expressly accepts these GTC as binding.
2. Services
Fliagmo provides mediation and organization of tandem paragliding flights with licensed professional tandem pilots. The execution of the flight itself is the sole responsibility of the respective pilot.
3. Participation requirements
• Body weight: between 20 kg and 120 kg
• Minimum age: 4 years (under 18 only with written consent of a legal guardian)
• No health restrictions (e.g. cardiovascular diseases, epilepsy, pregnancy, etc.)
The passenger is obliged to provide truthful information about their health condition.
4. Weather and safety conditions
Tandem flights depend on the weather. The respective pilot alone decides on the execution, postponement, or cancellation of a flight for safety reasons. In case of cancellation due to weather, an alternative date will be offered. A refund is only possible if no alternative date can be arranged.
5. Withdrawal / cancellation by the passenger
• Free cancellation up to 24 hours before the scheduled flight
• From 24 hours before the flight or in case of no-show: full price must be paid
• A substitute person may be named, provided they meet the participation requirements
6. Withdrawal by the provider
The provider may cancel a flight in the event of adverse weather conditions, force majeure, or organizational reasons. An alternative date will be offered. Further claims against the provider are excluded.
7. Responsibility and liability
Fliagmo acts exclusively as an intermediary and organizer of tandem flights. The actual flight is conducted legally, professionally, and entirely independently by the respective pilot.
The provider (Fliagmo) is not liable for damages or accidents occurring during the flight. Responsibility and liability for the flight as well as the passenger’s safety lie solely with the pilot – regardless of where or through whom the flight was booked or paid.
The passenger acknowledges that:
• the pilot acts independently,
• they take the flight at their own risk,
• all decisions regarding flight execution, take-off, safety, and landing rest with the pilot.
8. Insurance
All tandem pilots used hold the legally required aviation liability insurance. Additional accident insurance is not included and remains the responsibility of the passenger.
9. Photo and video recordings
If photos or video recordings are made during the flight, the passenger consents to their use for private or promotional purposes by Fliagmo – unless expressly objected to.
10. Vouchers
Vouchers are valid for 1 year from the date of issue. After expiry, redemption is only possible by agreement and subject to a surcharge. Cash payment is excluded. Redemption is only possible upon prior appointment.
11. Place of jurisdiction and applicable law
Exclusively the law of the Italian Republic applies. The place of jurisdiction, as far as legally permissible, is the seat of the provider.
12. Severability clause
Should any provision of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, a provision shall apply that comes closest to the intended economic purpose.
